Business Inspections

Fire prevention

Fire prevention inspections are the single most important non-fire fighting activity performed by the fire service. These inspections are directed toward conditions and practices that may result in the threat to life or property from fire or unsafe activities. Comprehensive building construction, electrical, and fire codes have been developed to provide for protection of life and property. The Fire Department's mission is to protect lives and property from the threat of fire, and the Department is devoted to fire prevention activities and code enforcement.

The Fire Prevention Bureau is a branch of the Fire Department's Hazard Prevention Division. The Fire Prevention Bureau duties consist of:

  • reviewing and approving all plans for new construction and tenant improvements
  • inspecting and testing new and existing fire protection systems
  • annual inspections of all commercial businesses, churches, schools, and manufacturing facilities
  • providing public safety education and hands-on training
  • investigating and determining the cause and origin of fires

How to schedule a fire and safety inspection

Any business owner, homeowner, or renter may request a Fire and Safety Inspection of their business or residence from the Fire Department at anytime. Fire and Safety Inspections are conducted weekdays, 8:00 a.m. to 12:00 noon and 1:00 p.m. to 5:00 p.m., excluding holidays.

Whenever a new business occupant replaces a previously occupied or vacated space or building a Fire and Safety Inspection should be conducted by the Fire Department. This inspection is very important since emergency contacts and phone numbers are acquired and updated in the 911 dispatch center. This emergency contact information is invaluable to the Fire and Police Departments if something should happen to your business or property during non business hours and holidays.

To request a Fire and Safety Inspection please call the Fire Prevention Bureau's Voice Mail at 790-7246 and leave your name, daytime phone number, and the address of the property to be inspected. A Fire Prevention Inspector will return your call within 24 hours, weekdays, 8:00 a.m. to 12:00 noon and 1:00 p.m. 5:00 p.m., to set up an appointment for the inspection.

If a non-emergency condition exists that requires immediate attention from the Fire Department, please call the Fire Administration Office at 790-7218, weekdays, 8:00 a.m. to 5:00 p.m. During evenings, weekends and holidays please call the Newark Police/Fire Dispatch Center at 790-7237 and describe your immediate need to the dispatcher for possible non-emergency response of a fire engine company.

To report any condition that is an immediate threat to life or property, call 911.

Hazardous Materials/CUPA Program

What is a CUPA?

A CUPA is a Certified Unified Program Agency, which is authorized to carry out several of the various hazardous materials regulatory programs administered by the State and City.

What does this mean for Newark?

It means local control over hazardous materials programs, better customer service, and cost savings. Being a CUPA combines the various State hazardous materials laws into one program, with the City of Newark's Municipal Code regulating hazardous materials, to create one program administered by the City's Fire Department. This allows for a streamlined hazardous materials program. For businesses, this means one inspector, one inspection, and one fee.

What laws and regulations are in the CUPA programs?

The State laws and regulations covered by the CUPA include:

  • Underground Tanks
  • Community Right to Know and Spill Notification
  • Accidental Release Program (Risk Assessment and Control of Extremely Hazardous Substances)
  • Above Ground Tanks
  • Hazardous Materials Inventory Reporting
  • Hazardous Waste Generator and First Three Tiered Permits, CA, CE, PBR
The City codes covered by the CUPA include:

  • Hazardous Materials Storage Permit Requirements
  • Uniform Fire Code Hazardous Materials Requirements
  • Industrial and Commercial Inspections for the City's Storm Water Program
What does the State require of a CUPA?

The State regulations require Alameda County's CUPAs to coordinate all aspects of the hazardous materials program with each other. The Alameda County's CUPAs use the same inspection and business forms, and report program information to the State in the same format. The CUPAs carry out enforcement and technical interpretation of the laws and regulations in a coordinated and consistent manner. The Alameda County CUPAs meet monthly and have set up a number of joint policy documents.

Who are the other CUPAs in Alameda County?

In addition to the Newark Fire Department, the other Alameda County CUPAs include the Berkeley Toxics Program, Fremont Fire Department, Hayward Fire Department, Livermore-Pleasanton Fire Department, Oakland Fire Department, San Leandro Hazardous Materials Department, Union City Environmental Program, and Alameda County Health Department (which covers Alameda, Albany, Emeryville, Piedmont, and unincorporated areas).
